RESOLUTION 20-3169 <br />A RESOLUTION OF THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, APPROVING A <br />MODEL HOME AGREEMENT BETWEEN THE CITY OF <br />CASSELBERRY AND MERITAGE HOMES OF FLORIDA, <br />INC. FOR THE LEGACY PLACE TOWNHOMES <br />DEVELOPMENT; PROVIDING FOR CONFLICTS <br />SEVERABILITY, AND AN EFFECTIVE DATE. <br />WHEREAS, Meritage Homes of Florida, Inc., a Florida corporation, is purchasing the <br />approximately 7.49 -acre property located at the northwest corner of Seminola Boulevard and <br />Murphy Road from LJL Land Group, LLC with Parcel Identification No. 26-20-30-5AR-OD00- <br />1300; and <br />WHEREAS, the City of Casselberry approved the site plan for the development of up to <br />sixty-four (64) townhome units on the Legacy Place Townhomes site; and <br />WHEREAS, Meritage Homes of Florida, Inc. requests to enter into a Model Home <br />Agreement with the City of Casselberry, as a form of a release, hold harmless, and <br />indemnification agreement, while a final plat is completed, and for the purpose of constructing a <br />Model Home Center and associated parking lot with landscaping, as indicated on the proposed <br />final plat as Building G; and <br />WHEREAS, the use and operation of the Model Home Center shall be in accordance <br />with the guidelines set forth within the attached Model Home Agreement. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELEBRRY, FLORIDA, AS FOLLOWS: <br />SECTION 1. Adoption of Resolution 20-3169 shall approve the attached Model Home <br />Agreement between the City of Casselberry and Meritage Homes of Florida, Inc. for the Legacy <br />Place Townhomes development on approximately 7.49 -acre property, located at the northwest <br />corner of Seminola Boulevard and Murphy Road with Parcel Identification No. 26-20-30-5AR- <br />OD00-1300. <br />SECTION 2. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION 3. Severability. If any Section or portion of a Section of this Resolution proves <br />to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, <br />force, or effect of any other Section or part of this Resolution. <br />SECTION 4. Effective Date. This Resolution shall become effective immediately upon its <br />passage and adoption. <br />
