continued violations may be so punished from time to time in spite of previous convictions or
<br />acquittals of the original violation or charge. No conviction or acquittal shall be deemed to bar
<br />any civil remedy to enforce compliance with the regulations of this Section or to abate any
<br />nuisance arising from a violation.

<br />ARTICLE I1. - COLLECTION
<br />DIVISION 1. - GENERALLY
<br />Sec. 70-31. - Definitions.
<br />The following words, terms and phrases, when used in this Article, shall have the meanings
<br />ascribed to them in this Section, except where the context clearly indicates a different meaning:
<br />City shall mean the City of Casselberry, Florida, a municipal corporation.
<br />Commercial establishment or Commercial business or Commercial customer shall mean any
<br />public or private place, building, and/or enterprise devoted in whole or in part to a business
<br />enterprise whether non-profit or profit-making in nature; except where such place site, building
<br />structure, and/or entemrise constitutes a single-family residence or multiple dwelling of four
<br />units or less Condominiums patio houses and other such facilities where the individual units
<br />are privately owned and used for residential purposes are not commercial establishments within
<br />the context of the definition of commercial establishments unless bulk collection for such
<br />facilities is used rather than individual residential unit collection.
<br />Container shall mean any portable, nonabsorbent enclosed container with a close -fitting
<br />cover, or doors, a rolling lidded cart, or large box -style dumpster, approved by the Health
<br />Department and the City, used to store garbage or non-putrescible trash Containers must be
<br />leak -proof and capable of being serviced by mechanical equipment, such as frontloading
<br />compactor, rearloading compactor, sideloading or roll -off truck. Containers may be used to
<br />collect recyclables, garbage, or non-putrescible trash.
<br />Dwelling unit means each unit in any single-family, duplex, triplex or multifamily
<br />residential living unit with kitchen facilities.
<br />Franchisees shall mean the individuals, partnerships, or corporations who/which agree, as
<br />hereinafter provided, to perform the work or service, or to furnish materials or equipment, or
<br />both, as set forth in the franchise agreements.
<br />Garbage shall mean every waste accumulation and animal and vegetable matter which
<br />attend the preparation, use, cooking, processing, handling, or storage of meats, fish, fowl, fruits,
<br />vegetables, or other matter which is subject to decomposition, decay, putrefaction, and the
<br />generation of offensive and noxious gasses or odors, or which during or after decay may serve as
<br />breeding or feeding materials for flies, insects, or animals.
<br />Multifamily dwelling unit means the individual unit in any building or structure with kitchen
<br />facilities capable of being utilized for residential living, other than a hotel or motel unit, and
<br />containing four or more units under one roof.
