Commander, and delegating to those officers certain emergency management powers provided in <br />Chapter 252, Florida Statutes; and <br />WHEREAS, on March 13, 2020, the President of the United States issued a Presidential <br />National Emergency Declaration for COVID-19 effective throughout the United States; and <br />WHEREAS, section 252.38, Florida Statutes, the State Emergency Management Act, <br />provides a municipality with authority and power to take every prudent action necessary to <br />ensure the health, safety, and welfare of members of the general public in response to emergency <br />crises; and <br />WHEREAS, on March 15, 2020, Seminole County Chairman, Jay Zembower, extended <br />the declared Local State of Emergency throughout Seminole County, effective for a period of <br />seven (7) days (and expiring on March 21, 2020) which may be extended as necessary in seven <br />(7) day increments; and <br />WHEREAS, section 252.38(2) of the State Emergency Management Act confers upon <br />municipalities the authority to implement emergency management programs consistent with the <br />emergency management programs of the state and county; and <br />WHEREAS, Section 30-7 of the City of Casselberry Code of Ordinances authorizes the <br />City Manager to declare a state of emergency with confirmation by the City Commission by <br />resolution, unless the nature of the emergency renders a meeting of the City Commission <br />extremely impractical; and <br />WHEREAS, the Casselberry City Commission desires to take timely and reasonable <br />action necessary to ensure the health, safety, and welfare of the citizens of Casselberry, City of <br />Casselberry employees and members of the general public, in response to the COVID-19 <br />emergency; and <br />WHEREAS, the Casselberry City Commission desires to exercise emergency <br />management powers consistent with the emergency management declarations of the Governor of <br />the state of Florida, Seminole County, and other municipalities within Seminole County. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELEBRRY, FLORIDA, AS FOLLOWS: <br />SECTION 1. The forgoing recitals are incorporated herein by this reference, deemed a <br />material part of this Resolution, and are cited as authority for the purposes of adopting this <br />Resolution and the powers conferred herein shall be broadly construed to ensure the protection <br />of the health, safety, and welfare of the citizens of Casselberry, City of Casselberry employees <br />and members of the general public. <br />SECTION 2. The Casselberry City Commission hereby declares a local state of <br />emergency throughout the municipal boundaries of the City as a result of the Coronavirus <br />Disease 2019 (COVID-19) public health crises. <br />2 <br />
