costs for operations and maintenance and increased debt service and capital costs due to customer growth and required capital improvements because of more stringent federal and state mandated standards and requirements, age of portions of the sewer and water systems: and WHEREAS, The City Commission finds that it is necessary to establish new sewer, reclaimed water and water rates to continue to provide for the health, safety, and general welfare of the sewer, reclaimed water and water customers of the City of Casselberry. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA: SECTION 1. That Article Il, SEWER, Section 86-30 (e, f), Waste disposal generally; connection to public sewer; Section 86-72, Schedule of Rates and Charges, Section 86-83, Review of Rates and Charges; and Article III, WATER, Section 86-187 (a)(1), Deposit, Required; Amount; Section 86-189 (1-8), Schedule of Rates and Charges, and Section 86-190, Review of Rates and Charges, of the City Code of the City of Casselberry, Florida, are hereby deleted in their entirety and substituted with the Code provisions as shown in Attachment A. SECTION 2 - SEVERABILITY. If any Section or portion of a Section of this Ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Ordinance. SECTION 3 - CODIFICATION. It is the intention of the City Commission of the City of Casselberry, Florida, and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinance of the City of Casselberry, Florida; that the Sections of this Ordinance may be renumbered or re -lettered to accomplish such intention; that the word, "Ordinance" may be changed to "Section," "Article," or other appropriate word.
