ORDINANCE 20-1530 <br />AN ORDINANCE OF THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AMENDING <br />CHAPTER 62, PENSIONS AND RETIREMENT, ARTICLE <br />1, POLICE OFFICERS' AND FIREFIGHTERS' PENSION <br />PLAN OF THE CODE OF ORDINANCES OF THE CITY OF <br />CASSELBERRY; AMENDING SECTION 62-2007, PRE- <br />RETIREMENT DEATH; AMENDING SECTION 62-2008, <br />DISABILITY; PROVIDING FOR CODIFICATION; <br />PROVIDING FOR SEVERABILITY OF PROVISIONS; <br />REPEALING ALL ORDINANCES IN CONFLICT <br />HEREWITH AND PROVIDING AN EFFECTIVE DATE. <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS; <br />SECTION I: That Chapter 62, Pensions and Retirement, Article XVIII, Police Officers' <br />and Firefighters' Pension Plan, of the Code of Ordinances of the City of Casselberry, is hereby <br />amended by amending Section 62-2007, Pre -Retirement Death, by adding paragraph (d), <br />Firefighter Cancer Presumption, to read as follows: <br />Ldj Firefighter Cancer Presumption. The presumption provided for in this paragraph <br />(d) shall apply to "cancer", as defined in F.S. $ 112.1816(1)(a) as amended <br />from time to time. Any Firefighter Member who dies and whose death is a result <br />of cancer or circumstances that arise out of the treatment of cancer, will be <br />considered to have died in the line of duty. <br />SECTION II: That Chapter 62, Pensions and Retirement, Article XVIII, Police Officers' <br />and Firefighters' Pension Plan, of the Code of Ordinances of the City of Casselberry, is hereby <br />amended by amending Section 62-2008, Disability, by amending subsection (b), In -Line of Duty <br />Presumptions, by adding paragraph (3), Firefighter Cancer Presumption, to read as follows: <br />(b) (3) Firefighter Cancer Presumption. The presumption provided for in <br />this paragraph (3) shall apply only to "cancer", as defined in F.S. <br />112.1816(1)(a), as amended from time to time. Any Firefighter Member <br />who becomes totally and permanently unable to perform useful and <br />efficient service as a Firefighter due to a diagnosis of cancer or <br />circumstances that arise out of the treatment of cancer will be conclusively <br />presumed to be disabled in-line of duty. <br />Ordinance 20-1530 <br />Pagel of 2 <br />
