ORDINANCE 20-1532 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />AMENDING THE CITY CODE OF ORDINANCES, CHAPTER 52, <br />HUMAN RESOURCES, ARTICLE 1, IN GENERAL, BY ADDING A NEW <br />SECTION 52-21, EMPLOYEE BACKGROUND SCREENING, <br />PERMITTING CRIMINAL HISTORY RECORD CHECKS FOR CERTAIN <br />MUNICIPAL EMPLOYEES, APPOINTEES, AND PRIVATE <br />CONTRACTORS; PROVIDING FOR CODIFICATION, CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, pursuant to F.S. §166.0442, the Human Resources Division finds it <br />important to be able to conduct thorough background screenings of potential employees, <br />appointees, or private contractors for criminal offenses nationwide, and the statute requires <br />implementation by ordinance; and <br />WHEREAS, the Level I background screening is a state -only name -based criminal <br />record check; and <br />WHEREAS, fingerprints are required to complete a Level II background screening <br />with the Federal Bureau of Investigation; and <br />WHEREAS, Section 52-21 will provide the City the ability to conduct both state <br />and national criminal history screening. <br />NOW THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF <br />THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION 1: The City Code of Ordinances, Chapter 52, Human Resources, <br />Article I, In General, is hereby amended by adding a new section to be numbered Section <br />52-21, which Section shall read as follows: <br />Sec 52-21. Employee background screening <br />Pursuant to Fla. Stat. 166.0442, each person applying for, or continuing <br />employment in, any position of city employment or appointment, any person who <br />is a private contractor, employee of a private contractor, vendor, repair person, or <br />delivery person having access to any public facility or publicly operated facility <br />that may affect security or public safety, may be required to be fingerprinted as <br />determined by the City Manager. <br />(1) The fingerprints obtained shall be submitted to the Florida Department of Law <br />Enforcement for a state criminal history record check and to the Federal Bureau of <br />Investigation for a national criminal history record check. <br />
