RESOLUTION 19-3141 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE EXECUTION OF A QUIT CLAIM DEED FOR THE CONVEYANCE OF THE CENTRAL V LIFT STATION, PARCEL ID #20-21-30-505-OA00-002A, TO SOUTH SEMINOLE NORTH ORANGE COUNTY WASTEWATER TRANSMISSION AUTHORITY; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the City of Casselberry is a member of the South Seminole North Orange County Wastewater Transmission Authority (SSNOCWTA) which is used to transport a portion of the City's wastewater to the City of Orlando's Iron Bridge Wastewater Facility for treatment and disposal; and WHEREAS, the Enabling Act that created SSNOCWTA in 1978 requires that all lift stations that pump wastewater into its transmission system be owned by SSNOCWTA; and WHEREAS, through title research it was discovered that the Central V Lift Station owned by the City of Casselberry is supposed to be owned by SSNOCWTA; and WHEREAS, a Quit Claim Deed is needed to convey the Central V Lift Station, Parcel ID #20-21-30-505-OA00-002A, to SSNOCWTA to fulfill the requirements of the Enabling Act; and WHEREAS, City staff has reviewed the Quit Claim Deed and finds it sufficient to meet the needs of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby authorizes the execution of the Quit Claim Deed for the conveyance of the Central V Lift Station to SSNOCWTA and authorizes the Mayor to execute said document on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION IV. Effective Date. This Resolution shall become effective immediately upon its passage and adoption.
