Where a permit is issued for removal of a tree, a tree replacement determination must be made in <br />accordance with Section 3-14.7, Tree replacement requirements. <br />A. Exemptions to tree protection requirements and permitting. The terms and provisions in this <br />Article shall apply to all real property lying within the City except: <br />1. Public protection. <br />a. Residential shall be defined as occupied single-family <br />home or a duplex. The term residential does not include multi -family property, common <br />areas owned by a homeowners or condominium association or vacant land zoned <br />residential. <br />b. Trees on a commercial property that pose an immediate and direct danger to <br />persons or property are not included in s. 163.045. Florida Statutesand may be removed <br />after receiving written authorization by the City and tree removal permit obtained. <br />SECTION II - CODIFICATION. It is the intention of the City Commission of the <br />City of Casselberry, Florida, and it is hereby ordained that the provisions of this Ordinance shall <br />become and be made a part of the Code of Ordinance of the City of Casselberry, Florida; that the <br />Sections of this Ordinance may be renumbered or re -lettered to accomplish such intention; that <br />the word, "Ordinance" may be changed to "Section," "Article," or other appropriate word. <br />SECTION III - CONFLICTS. All Ordinances or Resolutions, or parts of Ordinances or <br />Resolutions in conflict with any of the provisions of this Ordinance are hereby repealed to the <br />extent of the conflict. <br />SECTION IV - SEVERABILITY. If any Section or portion of a Section of this <br />Ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or <br />impair the validity, force, or effect of any other Section or part of this Ordinance. <br />SECTION V - EFFECTIVE DATE.
