ORDINANCE 19-1522 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO <br />AMEND THE CITY OF CASSELBERRY COMPREHENSIVE PLAN BY <br />PROVIDING FOR A CHANGE OF THE FUTURE LAND USE <br />DESIGNATION FROM LOW DENSITY RESIDENTIAL TO <br />COMMERCIAL FOR THE APPROXIMATELY 0.69 ACRE PARCEL <br />LOCATED AT 245 LAKE ELLEN DRIVE, AS DESCRIBED IN SECTION I <br />OF THIS ORDINANCE; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND AN EFFECTIVE DATE. <br />WHEREAS, the subject property described in attached "Attachment A" ("Property") is <br />within the corporate boundaries of the City of Casselberry; and <br />WHEREAS, to allow for appropriate future development, the Property should be <br />developed consistent with the land uses of neighboring parcels; and <br />WHEREAS, the Property is less than 10 acres, requiring a small scale amendment to the <br />Comprehensive Plan; and <br />WHEREAS, Section 163.3187, Florida Statutes, establishes a process for adoption of <br />small scale comprehensive plan amendments including amendments to the Future Land Use Map <br />(FLUM); and <br />WHEREAS, the Planning and Zoning Commission/Local Planning Agency has held a <br />public hearing with due public notice to consider this FLUM amendment; and <br />WHEREAS, a public hearing considering amendment of the City of Casselberry FLUM <br />designation for the property hereinafter described, has been duly held by the City Commission of <br />the City of Casselberry, Florida, and at such hearing, interested parties and citizens were heard; <br />and <br />WHEREAS, after said public hearing, the City Commission of the City of Casselberry, <br />Florida, considered the Comprehensive Plan amendment and determined that the Future Land Use <br />designation of the Property, consisting of approximately 0.69 acres, shall be established as <br />Commercial, as defined in Future Land Use Element Objective FLU 1, as amended and <br />supplemented, of the Comprehensive Plan of the City of Casselberry, Florida; and <br />WHEREAS, such amendment is permitted, subject to the provisions of Chapter 163 of the <br />Florida Statutes. <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. Chapter 66, Section 66-29 of the Code of Ordinances of the City of <br />Casselberry, Florida, as amended and supplemented, adopting the Comprehensive Plan of the City <br />of Casselberry, Florida, regulating and restricting the use of lands within the City of Casselberry, <br />Florida, is hereby amended to designate the Property described in "Attachment A", consisting of <br />approximately 0.69 acres, from Low Density Residential to Commercial as shown in "Attachment <br />B". <br />
