of general circulation in the City in the manner provided by law. The notice shall be <br />published at least 30 days prior to the bond referendum election, once in the fifth week <br />prior, and once again in the third week prior to the week in which the bond referendum <br />election is held, all in the manner provided in Section 100.342, Florida Statutes. The City <br />Clerk is hereby charged with the responsibility of this notice procedure. <br />SECTION 9. ELECTION RESULTS. If a majority of the votes cast at the <br />referendum election in respect to the proposition are "YES - For Bonds" votes, such <br />proposition shall be approved and the Bonds may be issued by the City. If a majority <br />of the votes cast at the referendum election are "NO -Against Bonds" votes, such <br />proposition shall be defeated and the Bonds may not be issued by the City. <br />SECTION 10. SUPERVISOR OF ELECTIONS. The City Clerk is hereby <br />authorized and directed to coordinate with and through the Supervisor of Elections of <br />Seminole County in carrying out the purposes of this Ordinance. <br />SECTION 11. LANGUAGES. To the extent required by law, the official ballot <br />and notice of bond referenda shall be published in both the English and the Spanish <br />languages. <br />SECTION 12. INTENT TO REIMBURSE. The City Commission hereby <br />expresses its intention that the City be reimbursed from the proceeds of the Bonds for <br />costs relating to the Project. Pending reimbursement, the City expects to use funds <br />on deposit in the City's general fund or other appropriate fund or account to pay such <br />costs. This Ordinance is intended to constitute with respect to the construction of the <br />Project a "declaration of official intent" within the meaning of Section 1.150-2 of the <br />Income Tax Regulations. <br />SECTION 13. CONFLICTS. All Ordinances or Resolutions or parts of <br />Ordinances or Resolutions in conflict with any of the provisions of this Ordinance are <br />hereby repealed to the extent of the conflict. <br />SECTION 14. SEVERABILITY. If any section, or portion of a section of this <br />Ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to <br />invalidate or impair the validity, force, or effect of any other section or part of this <br />Ordinance. <br />[Remainder of Page Intentionally Left Blank] <br />41 <br />
