ORDINANCE 19-1521 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO ADOPT THE FIVE YEAR CAPITAL IMPROVEMENT PROGRAM 2019-2023 AS PART OF THE CITY'S COMPREHENSIVE PLAN IN ACCORDANCE WITH MANDATES SET FORTH IN CHAPTER 163, FLORIDA STATUTES; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the City of Casselberry has a five year Capital Improvement Program that is updated annually and is also known as the Capital Improvement Plan and the Capital Improvement Schedule of the City of Casselberry; and WHEREAS, the Florida Legislature intends that local planning be a continuous and on- going process; and WHEREAS, the City Commission adopted an amendment to the Fiscal Year 2019-2023 Capital Improvement Program on June 24, 2019 through Resolution 19-3100; and WHEREAS, the amended Fiscal Year 2019-2023 Capital Improvement Program should be incorporated into the City's Comprehensive Plan; and WHEREAS, the growth management legislation, F.S. 163.3177(3), provides that modifications to update the five year Capital Improvement Schedule may be accomplished by ordinance. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission does hereby adopt the amended Fiscal Year 2019-2023 Capital Improvement Program into the City of Casselberry's Comprehensive Plan, attached hereto as Attachment "A," and incorporated by reference. SECTION II. CONFLICTS. All Ordinances or Resolutions, or parts of Ordinances or Resolutions, in conflict with any of the provisions of this Ordinance are hereby repealed to the extent of the conflict. SECTION III. SEVERABILITY. If any Section or portion of a Section of this Ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Ordinance. SECTION IV. EFFECTIVE DATE. This Ordinance shall become effective ten (10) days after its passage and adoption.
