ORDINANCE 19-1519 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF CASSELBERRY COMPREHENSIVE PLAN BY PROVIDING FOR A CHANGE OF THE FUTURE LAND USE DESIGNATION FROM INDUSTRIAL TO COMMERCIAL FOR THE APPROXIMATELY 3.48 ACRE PARCEL LOCATED AT 1085 BELLE AVENUE, AS DESCRIBED IN SECTION I OF THIS ORDINANCE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the subject property described in attached "Attachment A" ("Property") is within the corporate boundaries of the City of Casselberry; and WHEREAS, to allow for appropriate future development, the Property should be developed consistent with the land uses of neighboring parcels; and WHEREAS, the Property is less than 10 acres, requiring a small scale amendment to the Comprehensive Plan; and WHEREAS, Section 163.3187, Florida Statutes, establishes a process for adoption of small scale comprehensive plan amendments including amendments to the Future Land Use Map (FLUM); and WHEREAS, the Planning and Zoning Commission/Local Planning Agency has held a public hearing with due public notice to consider this FLUM amendment; and WHEREAS, a public hearing considering amendment of the City of Casselberry FLUM designation for the property hereinafter described, has been duly held by the City Commission of the City of Casselberry, Florida, and at such hearing, interested parties and citizens were heard; and WHEREAS, after said public hearing, the City Commission of the City of Casselberry, Florida, considered the Comprehensive Plan amendment and determined that the Future Land Use designation of the Property, consisting of approximately 3.48 acres, shall be established as Commercial, as defined in Future Land Use Element Objective FLU 1, as amended and supplemented, of the Comprehensive Plan of the City of Casselberry, Florida; and WHEREAS, such amendment is permitted, subject to the provisions of Chapter 163 of the Florida Statutes. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. Chapter 66, Section 66-29 of the Code of Ordinances of the City of Casselberry, Florida, as amended and supplemented, adopting the Comprehensive Plan of the City of Casselberry, Florida, regulating and restricting the use of lands within the City of Casselberry, Florida, is hereby amended to designate the Property described in "Attachment A", consisting of approximately 3.48 acres, from Industrial to Commercial as shown in "Attachment B".
