ORDINANCE 19-1518 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO <br />AMEND THE CITY OF CASSELBERRY OFFICIAL ZONING MAP AS <br />ESTABLISHED IN CHAPTER II, ARTICLE IV, SECTION 2-4.3, <br />UNIFIED LAND DEVELOPMENT REGULATIONS OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS AMENDED AND SUPPLEMENTED; <br />AMENDING THE ZONING CLASSIFICATION FROM CG <br />(COMMERCIAL GENERAL) TO PMX-HIGH (PLANNED MIXED-USE: <br />HIGH RISE) FOR APPROXIMATELY 6.891 ACRES GENERALLY <br />LOCATED ON THE NORTHWEST CORNER OF EAST ALTAMONTE <br />DRIVE AND SOUTH U.S. HIGHWAY 17-92, AS DESCRIBED IN <br />SECTION I OF THIS ORDINANCE; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND AN EFFECTIVE DATE. <br />WHEREAS, the subject property described in attached "Attachment A" ("Property") is <br />within the corporate boundaries of the City of Casselberry; and <br />WHEREAS, the Property consists of Parcel #17-21-30-300-OO1A-0000 and Parcel <br />#17-21-30-300-0110-0000, which are adjacent and joined in this Ordinance through letters of <br />authorization from the property owners; and <br />WHEREAS, the Planning and Zoning Commission/Local Planning Agency has held a <br />public hearing with due public notice to consider this Official Zoning Map amendment; and <br />WHEREAS, the Future Land Use designation of the Property was amended to Major <br />Thoroughfare Mixed -Use (MTMU) on the Future Land Use Map (FLUM) of the Comprehensive <br />Plan via Ordinance 10-1323 and Ordinance 19-1513; and <br />WHEREAS, the PMX-HIGH zoning district is consistent with the MTMU Future Land <br />Use designation; and <br />WHEREAS, a public hearing considering the inclusion of the Property within the PMX- <br />HIGH zoning district has been duly held in the City of Casselberry, Florida, and, at such hearing, <br />interested parties and citizens were given the ability to speak and were heard; and <br />WHEREAS, after said public hearing, the City Commission of the City of Casselberry, <br />Florida, determined that the requested zoning change is consistent with the City of Casselberry's <br />Comprehensive Plan Future Land Use Map and is in compliance with all applicable procedures <br />of the Unified Land Development Regulations of the City of Casselberry, Florida; and <br />WHEREAS, based on the foregoing, the City Commission of the City of Casselberry has <br />determined the zoning classification of said property shall be PMX-HIGH, as that district is <br />defined in Articles IV and V of Chapter II, as amended and supplemented, of the Unified Land <br />Development Regulations, Code of Ordinances of the City of Casselberry, Florida. <br />
