WHEREAS, the City has worked extensively with FWC regarding resolutions that will <br />adequately protect and afford the greatest benefit to the City and the policies described herein; and <br />WHEREAS, on or about April 22, 2019, the City and FWC entered into that certain <br />amicable Memorandum of Understanding relating to the subject matter of this ordinance and which <br />functions as the mutually agreeable implementation of the City's goals and the FWC's existing <br />administrative code regulations; and <br />WHEREAS, the City determines, in accordance with Florida Administrative Code <br />Chapter 68A-19, that uplands within the City's current jurisdictional limits should be and are <br />hereby made and declared a restricted hunting area; and <br />WHEREAS, the City previously designated the entire City as a Bird Sanctuary in Section <br />18-3 of the City Code, which will remain on the books to provide protection for the City's birds, <br />and <br />WHEREAS, nothing herein is intended to conflict with Resolution 18-3006, Ordinance <br />17-1468, and Section 18-3 of the City Code; and <br />WHEREAS, words with double underlined type shall constitute additions to the original <br />text and strike- thr-ough type shall constitute deletions to the original text, and asterisks (* * *) <br />indicate that text shall remain unchanged from the language existing prior to adoption of this <br />Ordinance. <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY CONI,NUSSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. LEGISLATIVE FINDINGS. The above recitals are hereby adopted as the <br />legislative findings of the City Commission. The City Commission finds and determines that there <br />is competent substantial evidence to support the findings and determinations made in this Section. <br />SECTION II. RESTRICTED HUNTING AREA DESIGNATION. In accordance with <br />Chapter 68A-19, Florida Administrative Code, all uplands within the City limits of the City of <br />Casselberry are hereby declared a restricted hunting area. <br />SECTION III. CASSELBERRY CITY CODE ATMENDNIENT. The Code of <br />Ordinances of the City of Casselberry, Florida, is hereby amended by adding a new section to be <br />numbered Section 18-4, to Chapter 18, Animals, which Section shall read as follows: <br />Sec. 18-4. - Restricted huntingareas <br />(a) General. The following area within the City limits of the City of Casselberry <br />f"City"i is hereby declared a restricted hunting area: all uplands within the City's <br />jurisdictional limits Such restricted hunting area shall include the airspace over and above <br />the restricted huntin area <br />Ordinance 19-1515 <br />Page 2 of 5 <br />
