Military <br />Trail, 4th Floor, Boca Raton, FL 33431 (hereinafter "GMA"); BAER'S FURNITURE CO., <br />INC., a Florida corporation, successor by merger to J. A. B. SHOPPING CENTER II, LLC, <br />whose address is 1589 Northwest 12th Avenue, Pompano Beach, Florida 33069 (hereinafter <br />"BAER'S); and the CITY OF CASSELBERRY, FLORIDA, whose address is 95 Triplet Lake <br />Drive, Casselberry, Florida 32707 ("City"). GMA and BAER'S are hereinafter collectively <br />referred to as "Owners". <br />WITNESSETH: <br />WHEREAS, GMA is the owner of that certain real property located in Casselberry, <br />Seminole County, Florida, more particularly described as follows: <br />Lots 1 and 4, Casselberry Marketplace Plat, according to the map or plat thereof <br />recorded in Plat Book 82, Page 74, of the Public Records of Seminole County, <br />Florida; <br />WHEREAS, BAER'S is the owner of that certain real property located in Casselberry, <br />Seminole County, Florida, more particularly described as follows: <br />Lot 3, Casselberry Marketplace Plat, according to the map or plat thereof recorded <br />in Plat Book 82, Page 74, of the Public Records of Seminole County, Florida; <br />WHEREAS, GMA and BAER'S property referenced above constitute a portion of the <br />shopping center project known as Casselberry Marketplace, located at the corner of Red Bug <br />Lake Road, and SR 436, in Casselberry, Florida (hereinafter "Property"); and <br />WHEREAS, certain existing buried private sewer lines (the "GMA-Baer's Sewer Lines") <br />owned by the Owners are located within the Property, as shown on the sketch attached hereto as <br />Exhibit "A", said GMA-Baer's Sewer Lines apparently having been installed by a prior owner <br />I <br />
