RESOLUTION 19-3097 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, FOR A SEWER LINES AGREEMENT WITH <br />GREATER MARKETPLACE ACQUISITION, LLC AND BAER'S <br />FURNITURE CO., INC. AND BILL OF SALE FOR THE SEWER LINES AT <br />CASSELBERRY MARKETPLACE; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the City was approached by Greater Marketplace Acquisition, LLC (Greater <br />Marketplace) regarding placing a playground behind one of the units located in the Casselberry <br />Marketplace Plaza; and <br />WHEREAS, there is currently City -owned water and sewer lines that run underneath the <br />proposed location for the playground that City staff would not be able to easily access or maintain; <br />and <br />WHEREAS, Greater Marketplace has agreed to relocate the water line to outside the <br />proposed location of the playground, grant it to the City, and dedicate an easement to the City for <br />maintenance purposes, per an agreement that will be submitted under a separate resolution; and <br />WHEREAS, due to the difficulty of relocating the gravity sewer lines, Greater Marketplace <br />has decided to assume ownership and responsibility of the sewer lines; and <br />WHEREAS, a Sewer Lines Agreement will stipulate the maintenance responsibility; and <br />WHEREAS, a Bill of Sale will transfer ownership of the sewer lines to Greater <br />Marketplace Acquisition, LLC and Baer's Furniture Co., Inc.; and <br />WHEREAS, City staff has reviewed the Sewer Lines Agreement and Bill of Sale and have <br />found them favorable to meet the needs of the City. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the Sewer <br />Lines Agreement with Greater Marketplace Acquisition, LLC and Baer's Furniture Co., Inc. and <br />Bill of Sale for the sewer lines at Casselberry Marketplace, attached herewith, and authorizes the <br />Mayor to execute said documents on behalf of the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />
