WHEREAS, Section 163.01(4), Florida Statutes, provides that public agencies of the State <br />of Florida may exercise jointly any power, privilege, or authority, which such agencies share in <br />common and which each might exercise separately; and <br />WHEREAS, COUNTY and CITIES are political subdivisions of Florida, which are <br />recognized as "public agencies" within the meaning of Section 163.01(3)(b), Florida Statutes <br />(2018); and <br />WHEREAS, the parties to this Agreement have the common power to regulate and control <br />animals within their respective geographic jurisdictions; and <br />WHEREAS, CITIES desire that Parts I and II of Chapter 20 of the Seminole County Code <br />(2018), which includes Sections 20.01-20.150 and is commonly referred to as the "Animal Control <br />Ordinance" be applicable within their geographic boundaries; and COUNTY is agreeable to <br />administering and enforcing these parts of Chapter 20, Seminole County Code, within the <br />geographic boundaries of the CITIES; and <br />WHEREAS, Section 1.4, Seminole County Home Rule Charter, asserts that municipal <br />ordinances prevail over County ordinances to the extent of any conflict; and <br />WHEREAS, Section 163.01(5), Florida Statutes (2018), provides that a joint exercise of <br />power by such public agencies shall be made by contract in the form of an interlocal agreement, <br />NOW, THEREFORE, for and in consideration of the promises, mutual covenants and <br />agreements contained in this Agreement by and between the parties and for the mutual benefit of <br />COUNTY and CITIES, and their respective citizens, the parties agree as follows: <br />Section 1. Recitals. The foregoing recitals are true and correct and form a material part <br />of the agreement upon which the parties have relied. <br />Section 2. Purpose. The purpose of this Agreement is to provide for the applicability and <br />enforcement of animal control services as outlined in Parts I and II of Chapter 20, Seminole County <br />Interlocal Agreement between Seminole County and Municipalities <br />for Animal Control Services <br />Page 2 of 17 <br />
