Ms. Hanna said the change to the Code requiring a tree removal permit would make it <br />easier for Code Compliance to track compliance. <br />The Commission expressed that there is no documentation to show there is a problem with the City's tree <br />canopy. A brief discussion ensued regarding the City's new tree planting program, Duke Energy/Arbor Day <br />Foundation free tree program, waiving the $15 tree removal permit fee, Tree City USA designation requirements, and <br />evidence required for Code Compliance to prove a tree was removed. <br />Ms. Hanna said that Duke Energy's website provides information that assists property owners in <br />determining the best location to plant specific species of trees on their property. <br />In response to the Commission's question, Ms. Hanna stated that staff did not research the tree <br />replacement requirements for other municipalities. <br />Ms. Hanna read an email that the City received from Mr. Richard Casselberry opposing the changes to the <br />tree removal permit requirements for single-family dwellings/duplexes (a copy is attached and made a part of the <br />minutes). <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />Ms. Borkert reviewed the standards that should be considered when reviewing land development <br />regulations. She said not all of the following standards would apply to this agenda item: <br />1. Consistent with the Comprehensive Plan <br />2. Conformance with other existing ordinances <br />3. Any changed conditions <br />4. Land use compatibility <br />5. Adequate public facilities <br />6. The natural environment <br />7. Economic effects <br />8. Orderly development <br />9. Public interest <br />A brief discussion ensued regarding the lack of documentation to demonstrate there is a loss to the City's <br />tree canopy, property rights, and eliminating the tree removal permit fee. <br />
