Motion was seconded by Commissioner Busch. <br />Motion carried unanimously by voice vote 5-0. <br />C. Resolution 19-3092 — Memorandum of Understanding with Florida Fish & Wildlife <br />Conservation Commission <br />"A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, <br />FLORIDA, AUTHORIZING THE EXECUTION OF A MEMORANDUM OF UNDERSTANDING <br />BETWEEN THE FLORIDA FISH AND WILDLIFE CONSERVATION COMMISSION AND THE <br />CITY OF CASSELBERRY; PROVIDING FOR CONFLICTS, SEVERABILITY, AND <br />EFFECTIVE DATE." <br />Staff Presentation: City Manager Randy Newlon stated that over the past couple of years the City had <br />experienced recurring incidents of people entering the City and the City's lakes for the purpose of duck <br />hunting, and in response to these issues the City had made a request to the Florida Fish and Wildlife <br />Conservation Commission (FWC) to establish a bird sanctuary or restricted hunting area within the <br />jurisdictional limits of the City of Casselberry, which was denied and is presently on appeal. In an effort <br />to settle the matter, the City Attorney and City staff have been working with staff and leadership at FWC <br />and have developed a Memorandum of Understanding which has been executed by FWC and is being <br />presented on this agenda for consideration by the City Commission. Approval of Resolution 19-3092 which <br />approves the Memorandum of Understanding with the Florida Fish and Wildlife Conservation Commission <br />(FWC) and authorizes the Mayor to execute said document on behalf of the City is requested. The <br />Memorandum of Understanding establishes that the City has the authority to enforce its own rules that may <br />be established with regard to restrictions on hunting as long as they are lawful, and expresses that FWC <br />will not interfere with the City's enforcement of these regulations. It also states that FWC would establish <br />a restricted hunting area under its authority for the City to enforce around the uplands around the lakes. <br />The City would follow up with the placing of signs notifying the public of the areas where duck hunting <br />would be restricted. <br />Mr. Newlon expressed appreciation to Ms. Reischmann and the Assistant City Attorney, Ms. Debra Babb- <br />Nutcher for their work with FWC to draft an agreement satisfactorily resolving the issue. In response to <br />questions from the City Commission, Mr. Newlon confirmed that the hunting restrictions that would be <br />allowed under the Memorandum of Understanding would be enforceable from both a legal and law <br />enforcement standpoint. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager recommended approval of Resolution 19-3092. <br />Audience Participation: No one came forward to address this item. <br />
