RESOLUTION 19-3090 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE EXECUTION OF AMENDMENT #3 TO THE COOPERATIVE AGREEMENT WITH THE UNITED STATES DEPARTMENT OF AGRICULTURE NATURAL RESOURCES CONSERVATION SERVICE FOR GEE CREEK AND HOWELL CREEK EROSION CONTROL FOR ADDITIONAL FEDERAL FUNDING; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the City of Casselberry experienced significant erosive damage within Gee Creek and Howell Creek basins as a result of Hurricane Irma in September 2017; and WHEREAS, the City Commission authorized City staff to submit an application to the United States Department of Agriculture Natural Resources Conservation Service (USDA NRCS) in an effort to obtain a grant to offset the costs associated with erosion control measures in Gee Creek and Howell Creek basins worsened by Hurricane Irma; and WHEREAS, on June 11, 2018, the City Commission approved a Cooperative Agreement with the USDA NRCS in which the NRCS awarded the City funding to assist with the erosion control in Gee Creek and Howell Creek basins; and WHEREAS, said Agreement provides for a total amount of financial assistance not to exceed $788,686.10 ($695,899.50 for construction and $92,786.60 for technical assistance), and a required 25% construction funding match (or $231,966.50) from the City; and WHEREAS, based on actual anticipated project costs, which will exceed the original Agreement amount, City staff requested consideration from NRCS for additional federal funding in the amount of $83,002.48, consisting of $55,556.17 in additional construction assistance and $27,446.31 in additional technical assistance; and WHEREAS, NRCS has provided a proposed Amendment to the Agreement to provide the requested additional funding; and WHEREAS, the proposed Amendment will require an additional City construction funding match of $18,518.72, which is already budgeted and available for the project; and WHEREAS, City staff has reviewed Amendment #3 to the Cooperative Agreement submitted by the United States Department of Agriculture Natural Resources Conservation Services and finds it favorable to meet the needs of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS:
