Addendum A <br />CU 19-04: Maximum Height Extension, Azul Lake Howell <br />February 13, 2019 Planning and Zoning Commission Meeting <br />Page 8 <br />Compliance with applicable laws and ordinances. Possession of both City and County <br />business tax receipts, as well as any applicable permits, licenses, and inspections from other <br />agencies must be provided to the City prior to the initiation of the business activity. <br />STAFF RECOMMENDATIONS <br />Staff recommends the Planning and Zoning Commission approve CU 19-04 to allow for a maximum height <br />extension from 35 feet to 48 feet 7 inches for the Azul at Lake Howell apartments. Staff's recommendation <br />is based on the findings of fact and conclusions of this staff report dated February 13, 2019, and the <br />following conditions: <br />1) The conditional use shall be limited to the sixteen (16) apartment buildings located within the Azul at <br />Lake Howell multi -family development as approved under SPR 18-25 <br />Howell development as WiGated In AttaGhment D. <br />2) The business shall remain in complete compliance with all City, County and State requirements. <br />3) The conditional use shall be valid for the same duration as the site plan approval of SPR 18-25. <br />4) Any hazardous waste produced through the construction and development of the apartment complex <br />shall be disposed of according to federal and state laws. No hazardous waste shall be produced on site <br />by future tenants. <br />5) All applicable licenses and permits shall be obtained prior to the commencement of any business <br />activities at the site. <br />6) All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />ATTACHMENTS <br />Attachment A — <br />SPR 18-25 Approval Letter <br />Attachment B — <br />Ordinance 19-1505 <br />Attachment C <br />— Letter of Intent <br />Attachment D <br />— Enlarged Site Plan <br />
