RESOLUTION 19-3078 A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING THE EXECUTION OF A RENEWAL TO THE HIGHWAY MAINTENANCE MEMORANDUM OF AGREEMENT CONTRACT NO. ARY45 BETWEEN THE FLORIDA DEPARTMENT OF TRANSPORTATION AND THE CITY OF CASSELBERRY; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, as per an existing Memorandum of Agreement (MOA) between the City of Casselberry and the Florida Department of Transportation (FDOT), the City of Casselberry provides routine and beautification right-of-way maintenance for portions of U.S. Highway 17-92 and S.R. 436; and WHEREAS, FDOT reimburses the City $132,000 per year for three (3) years, for a total amount of $396,000, for providing these services; and WHEREAS, the existing MOA will expire on April 30,2019; and WHEREAS, the City of Casselberry wishes to continue an active role in beautification and maintenance of these roadways; and WHEREAS, FDOT has submitted a renewal to the MOA that extends the contract an additional three (3) years and maintains the current terms and financial compensation; and WHEREAS, Public Works staff has reviewed the Renewal Contract to the FDOT Highway Maintenance Memorandum of Agreement, Contract No. ARY45 between the City of Casselberry and FDOT and finds it favorable to the City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the Renewal Contract to the Highway Maintenance Memorandum of Agreement between the Florida Department of Transportation and the City of Casselberry, Contract No. ARY45, and authorizes the Mayor to execute said document(s) on behalf of the City. SECTION II. The City Commission hereby accepts the tenns and conditions as presented in said Agreement. SECTION III. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed.
