This agreement is a compromise of disputed claims and shall not in any way be <br />construed as an indication or admission by either party that it or its agents or <br />employees have acted improperly regarding the other party or any other person or <br />entity. <br />J. In light of the foregoing understanding between the parties, the City agrees <br />to withdraw its Sanctuary Request to FWC and FWC agrees to withdraw its <br />Denial Letter. The City further agrees to dismiss with prejudice its Petition <br />for Administrative Hearing filed with the Division of Administrative <br />Hearings, Case Number 18- 006501. Each party will bear its own attorneys' <br />fees and costs. <br />K. This agreement settles all appeals, challenges, claims, or causes of action of any kind <br />and of whatever nature, which have been, or which might be made based solely on <br />the particular facts or circumstances arising from this matter. The parties hereby <br />waive all right of appeal or challenge of any kind whatsoever and in any forum <br />whatsoever. <br />L. It is mutually understood and agreed by and between the parties that modification to <br />this MOU shall be made only by mutual consent of the parties, by the issuance of a <br />written modification, signed and dated by all parties, prior to any changes being <br />performed. <br />M. This agreement shall be governed by and interpreted in accordance with the laws of <br />the State of Florida.
