areas designated High Intensity Nonresidential/Medium Density Residential on the City of <br />Casselberry Comprehensive Plan Future Land Use Map, building heights in excess of 35 feet <br />may be allowed pursuant to site development approval. <br />In all cases, the setback requirement for yards which abut any residentially zoned area which is <br />not in an area designated by the City of Casselberry Comprehensive Plan Future Land Use Map <br />as Low Intensity Nonresidential/Medium Density Residential or High Intensity <br />Nonresidential/Medium Density Residential, shall be an additional 15 feet for each additional ten <br />feet in height or fraction thereof in excess of 35 feet. <br />In addition to the regular landscape and buffering requirements of this Code, a minimum six foot <br />high masonry wall of decorative construction shall be provided along any yard boundary which <br />abuts any residentially zoned area and/or planned to be residentially zoned which is not in an <br />area designated by the City of Casselberry Comprehensive Plan Future Land Use Map as Low <br />Intensity Nonresidential/Medium Density Residential or High Intensity Nonresidential/Medium <br />Density Residential. In those instances where a minimum 4-00 50 feet of buffer or natural area is <br />provided the Planning and Zoning Commission/Land Planning Agency may waive this <br />requirement provided the retention and perpetual maintenance of significant sight obscuring <br />vegetation. <br />In any event a final determination as to the allowable height of any building will be based upon <br />the City's ability to ensure an acceptable level of service for all necessary public facilities and <br />services to that building. <br />SECTION 4 - CODIFICATION. The City Commission of the City of Casselberry, <br />Florida, intends, and ordains that this Ordinance become a part of the Code of Ordinance of the <br />City of Casselberry, Florida; that the Sections of this Ordinance may be renumbered or re - <br />lettered to accomplish such intention; that the word, "Ordinance" may be changed to "Section," <br />"Article," or other appropriate word. <br />SECTION 5 - CONFLICTS. All Ordinances or parts of Ordinances in conflict with any <br />of the provisions of this Ordinance are repealed. <br />SECTION 6 - SEVERABILITY. If any Section or portion of a Section of this <br />Ordinance proves to be invalid, unlawful, or unconstitutional, it will not invalidate or impair the <br />validity, force, or effect of any other Section. <br />SECTION 7 - EFFECTIVE DATE.
