Orange Ave., Ste. 2000 <br />Orlando, FL 32801 <br />Return to: <br />City Clerk <br />City of Casselberry <br />95 Triplet Lake Drive <br />Casselberry, FL 32707 <br />Parcel Id: 17-21-30-300-009A-0000 <br />AGREEMENT REGARDING UTILITY EASEMENT <br />THIS AGREEMENT ("Agreement") is made and entered into this 2-:1 day of <br />@fit 2018, by and between J & J INVESTMENT HOLDINGS CORP., a Florida <br />corporation, whose address is 3965 S Saint Johns Parkway, Sanford, FL 32771, ("J&J") and the <br />CITY OF CASSELBERRY, a Florida municipal corporation, whose address is 95 Triplet Lake <br />Drive, Casselberry, FL 32707, ("City"). <br />WITNESSETH: <br />WHEREAS, J&J Investment Holdings Corp., successor in interest to Orograin Bakeries <br />Sales, Inc., owns the real property locate' in Seminole County, Florida, as more particularly <br />described on Exhibit "A" attached hereto d incorporated herein by this reference (hereinafter <br />referred to as the "Property"); and <br />WHEREAS, in 2013, the parties executed a Utility Easement, recorded in O.R. Book 8154, <br />Pages 1318-1329, Public Records of Seminole County, Florida ("Utility Easement"), in which the <br />City agreed to provide labor and materials to the Property to: <br />(a) Connect the sanitary sewer lines running from the existing building on the Property to <br />the new sanitary sewer line being installed and operated as part of the Facilities; <br />(b) Install landscaping to screen the sanitary sewer pump station as depicted on the <br />Landscape Plan attached ... from the neighboring properties; and <br />(c) Complete the abandonment of the on-site septic system in accordance with all <br />applicable governmental requirements; <br />and <br />WHEREAS, in lieu of the City providing the labor and materials for the work listed in (a) <br />— (c) above, J&J has offered to hire a contractor to provide the required construction services to <br />satisfy all of the City's outstanding obligations in the Utility Easement; and <br />
