RESOLUTION 18-3063 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, TO ENTER INTO AN AGREEMENT WITH J & J INVESTMENT HOLDINGS CORP. FOR SEPTIC TANK ABANDONMENT AND CONNECTION TO THE CITY'S SEWER SYSTEM FOR PROPERTY LOCATED AT 1531 E. ALTAMONTE DRIVE, FCP_—�; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, on October 28, 2013, the City executed an Utility Easement with Orograin Bakeries Sales, Inc. regarding the property located at 1531 E. Altamonte Drive, �sel�e 7, FL -323-F; and ern Oe,,,rk E3 XI ," s WHEREAS, this agreement provided for the establishment of an easement on the property to build, operate and maintain a lift station that would provide City sewer services to this and neighboring properties in the area; and WHEREAS, pursuant to this agreement, the City is required to facilitate the abandonment of the tank on this property and connect the old sewer lines to the new sewer system now that the lift station has been constructed; and WHEREAS, J & J Investment Holdings Corp., the current owner of the property, has offered to hire a contractor for an amount not to exceed $7,500.00 to fulfill the City's obligations of septic tank abandonment and connection to the City's sewer system; and WHEREAS, Public Works staff has reviewed the proposal and finds it more cost effective than the costs of labor and materials to complete the work in-house and reasonable to meet the needs of the City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the Agreement with J & J Investment Holdings Corp., attached as Exhibit A, for septic tank abandonment and connection to the City's sewer system and authorizes the Mayor to execute said document on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution.
