Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />October 10, 2018 <br />Page 2 <br />Mr. Dean Fathelbab, Planner II, reviewed the information provided in his memorandum dated October 10, <br />2018, to the City of Casselberry Planning and Zoning Commission. Mr. Fathelbab said based on the City Attorney's <br />review of the plat the conditions of approval have been revised which have been provided in Addendum A that was <br />distributed to the Planning and Zoning Commission (a copy is attached and made a part of the minutes). <br />Mr. Fathelbab said staff requests the Planning and Zoning Commission review the 1200 Seminola <br />Boulevard (SP 18-01), replat, and provide a recommendation of approval to the City Commission based upon the plat <br />dated September 26, 2018, the findings of fact and conclusions of the staff report dated October 10, 2018, and the <br />conditions of approval outlined in Addendum A. The conditions of approval are: <br />1. The City Surveyor shall execute the signature block prior to recording of the replat. <br />2. The Declaration of Access Easement shall be recorded with Seminole County upon final review and <br />approval of the City Attorney and prior to recording the replat. The Declaration of Access Easement <br />recording information must be noted on the replat. <br />3. Prior to the recording of the Declaration of Access Easement, once approved by the City Attorney, and <br />before the replat is recorded, the applicant shall first rescind the declaration, which was previously <br />recorded in error. <br />In response to the Commission's question, Mr. Fathelbab explained that there was some miscommunication <br />between the applicant's attorneys and staff regarding providing a draft of the Declaration of Access Easement to staff <br />for review. He said the document was recorded in error about a month ago. <br />In response to the Commission's question, Mr. Fathelbab reviewed the boundaries of the plat. He said that <br />the polygon is not a true representative of the legal description of the property. He said the legal descriptions match <br />on the plat. Mr. Fathelbab said both the City Surveyor and the City Attorney have reviewed the plat. <br />Mr. Henson asked the applicant to come forward. Ms. Ana Karina Perez, future property owner, 1200 <br />Seminola Boulevard, Casselberry, Florida came forward. There were no questions for the applicant. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />Mr. Henson asked for a motion to address SP 18-01. Mr. Phillips made a motion that the Planning and <br />Zoning Commission reviewed the 1200 Seminola Boulevard (SP 18-01), replat, and is providing a recommendation <br />of approval to the City Commission based upon the plat dated September 26, 2018, the findings of fact and <br />
