ORDINANCE 18-1495
<br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO
<br />AMEND THE CITY OF CASSELBERRY COMPREHENSIVE PLAN BY
<br />PROVIDING FOR A CHANGE OF THE FUTURE LAND USE
<br />DESIGNATION FROM INDUSTRIAL (I) TO COMMERCIAL (C) FOR
<br />THE PARCEL LOCATED AT 177 ANCHOR ROAD, CASSELBERRY,
<br />FLORIDA, AS DESCRIBED IN SECTION I OF THIS ORDINANCE;
<br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE
<br />DATE.
<br />WHEREAS, the property described in Section I of this Ordinance is within the corporate
<br />boundaries of the City of Casselberry; and
<br />WHEREAS, the property provided in Section I of this Ordinance is less than 10 acres,
<br />requiring a small-scale amendment to the Comprehensive Plan; and
<br />WHEREAS, to allow for appropriate future development, such property should be
<br />developed consistent with the land uses of neighboring parcels; and
<br />WHEREAS, Section 163.3187, Florida Statutes, establishes a process for adoption of
<br />small-scale comprehensive plan amendments including amendments to the future land use map
<br />(FLUM); and
<br />WHEREAS, the Planning and Zoning Commission/Local Planning Agency has held a
<br />public hearing with due public notice to consider this FLUM amendment; and
<br />WHEREAS, a public hearing considering amendment of the City of Casselberry Future
<br />Land Use Map designation for the property hereinafter described, has been duly held by the City
<br />Commission of the City of Casselberry, Florida, and at such hearing, interested parties and citizens
<br />were heard; and
<br />WHEREAS, after said public hearing, the City Commission of the City of Casselberry,
<br />Florida, considered the Comprehensive Plan Amendment and determined that the Future Land Use
<br />designation of the property shall be established as Commercial, as defined in Future Land Use
<br />Element Objective FLU 1, as amended and supplemented, of the Comprehensive Plan of the City
<br />of Casselberry, Florida; and
<br />WHEREAS, such amendment is permitted, subject to the provisions of Chapter 163 of the
<br />Florida Statutes.
<br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE
<br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS:
<br />SECTION I. That Chapter 66, Section 66-29 of the Code of Ordinances of the City of
<br />Casselberry, Florida, as amended and supplemented, said Chapter adopting the Comprehensive
<br />Plan of the City of Casselberry, Florida, regulating and restricting the use of lands within the City
<br />of Casselberry, Florida, be, and the same is, hereby amended to designate the subject property as
<br />Commercial, for the parcel of land specifically described as follows, and shown in Attachment A:
