ORDINANCE 18-1493 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO <br />AMEND THE CITY OF CASSELBERRY COMPREHENSIVE PLAN BY <br />PROVIDING FOR A CHANGE OF THE FUTURE LAND USE <br />DESIGNATION FROM INDUSTRIAL (I) TO COMMERCIAL (C) FOR <br />THIRTY-FIVE (35) PARCELS TOTALING APPROXIMATELY 4.5 <br />ACRES GENERALLY LOCATED AT 910, 920, AND 930 BELLE AVE AS <br />DESCRIBED IN SECTION I OF THIS ORDINANCE; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. <br />WHEREAS, the properties described in Section 1 are within the corporate boundaries of <br />the City of Casselberry; and <br />WHEREAS, properties provided in Section I of this ordinance are less than 10 acres, <br />requiring a small-scale amendment to the Comprehensive Plan; and <br />WHEREAS, to allow for appropriate future development, such properties should be <br />developed consistent with the land uses of neighboring parcels; and <br />WHEREAS, Section 163.3187, Florida Statutes, establishes a process for adoption of <br />small-scale comprehensive plan amendments including amendments to the future land use map <br />(FLUM); and <br />WHEREAS, the Planning and Zoning Commission / Local Planning Agency has held a <br />public hearing with due public notice to consider this FLUM amendment; and <br />WHEREAS, a public hearing considering amendment of the City of Casselberry Future <br />Land Use Map designations for the properties hereinafter described, has been duly held by the City <br />Commission of the City of Casselberry, Florida, and at such hearing, interested parties and citizens <br />were heard; and <br />WHEREAS, after said public hearing, the City Commission of the City of Casselberry, <br />Florida, considered the Comprehensive Plan Amendment and determined that the Future Land Use <br />designation of the properties shall be established as Commercial, as defined in Future Land Use <br />Element Objective FLU 1, as amended and supplemented, of the Comprehensive Plan of the City <br />of Casselberry, Florida; and <br />WHEREAS, such amendments are permitted, subject to the provisions of Chapter 163 of <br />the Florida Statutes. <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. That Chapter 66, Section 66-29 of the Code of Ordinances of the City of <br />Casselberry, Florida, as amended and supplemented, said Chapter adopting the Comprehensive <br />Plan of the City of Casselberry, Florida, regulating and restricting the use of lands within the City <br />of Casselberry, Florida, be, and the same is, hereby amended to designate the subject properties as <br />Commercial, for the parcels of land specifically described as follows, and shown in Attachment <br />A: <br />
