RESOLUTION 18-3057 <br />A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, <br />AUTHORIZING THE EXECUTION OF THE SECOND AMENDMENT <br />TO THE VACANT LAND CONTRACT BETWEEN JOHN <br />CASSELBERRY AND THE CITY OF CASSELBERRY FOR THE <br />PROPERTY LOCATED AT S. LOST LAKE LANE, PARCEL ID 09-21-30- <br />5BO-OA00-00IC; PROVIDING FOR CONFLICTS, SEVERABILITY, AND <br />EFFECTIVE DATE. <br />WHEREAS, the City Commission of the City of Casselberry entered into a Contract for <br />Purchase and Sale dated October 30, 2017 (hereinafter "Contract"), and the Seller utilized his <br />two unilateral closing date extensions under the terms of the Contract; and <br />WHEREAS, the Seller requested another extension of the closing date to September 6, <br />2018 to provide more time to negotiate a settlement of a foreclosure lawsuit on another parcel of <br />real property owned by the Seller, which was provided by the First Amendment to the Vacant <br />Land Contract and approved by the City Commission on June 25, 2018 via Resolution 18-3035; <br />and <br />WHEREAS, settlement of the foreclosure lawsuit has not yet been reached and the Seller <br />has requested another extension of the closing date to November 6, 2018 as provided by the <br />Second Amendment to the Vacant Land Contract; and <br />WHEREAS, the Second Amendment also grants the City Manager the authority to sign <br />future amendments to extend the closing date of the Vacant Land Contract with Mr. Casselberry. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF CASSELBERRY, <br />FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the <br />Second Amendment to the Vacant Land Contract with John Casselberry (attached hereto as <br />"Exhibit A"),and authorizes the Mayor to execute said Second Amendment on behalf of the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of <br />the provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />
