ORDINANCE 18-1486 <br />AN ORDINANCE OF THE CITY COMMISSION OF THE CITY <br />OF CASSELBERRY, FLORIDA, RELATING TO <br />COMMUNICATION FACILITIES; AMENDING THE CITY <br />UNIFIED LAND DEVELOPMENT REGULATIONS BY <br />AMENDING SECTION 2-7.36, "COMMUNICATION TOWER, <br />COMMUNICATION ANTENNA, AND WIRELESS <br />COMMUNICATION FACILITY REGULATIONS" WITHIN <br />ARTICLE VII, "GENERAL REGULATIONS" OF CHAPTER II, <br />"DISTRICT AND GENERAL REGULATIONS" TO CLARIFY <br />REGULATIONS REGARDING COMMUNICATION TOWERS, <br />COMMUNICATION ANTENNAS, AND WIRELESS <br />COMMUNICATION FACILITIES; AND BY AMENDING <br />SECTION 5-21.2, "DEFINITION OF TERMS" OF ARTICLE <br />XXI, "LANGUAGE AND DEFINITIONS" OF CHAPTER V, <br />"GLOSSARY" TO ADD DEFINITIONS; PROVIDING FOR <br />CODIFICATION, CONFLICTS, SEVERABILITY AND AN <br />EFFECTIVE DATE. <br />WHEREAS, advances in telecommunications infrastructure have been developed which <br />help to meet wireless system capacity demands in dense areas through the deployment of localized <br />networks of antennas; and <br />WHEREAS, Section 337.401 et seq., Florida Statutes, addresses, inter alia, the authority <br />of municipalities to regulate the placement and maintenance of communications facilities in the <br />public rights-of-way; and <br />WHEREAS, the Florida Legislature has adopted, and on June 23, 2017, the Governor <br />signed into law, effective July 1, 2017, the Advanced Wireless Infrastructure Deployment Act (the <br />"Act") codified at Section 337.401, Florida Statutes, which places certain limitations on local <br />government authority to regulate the collocation of small wireless facilities within public rights- <br />of-way; and <br />Page 1 of 37 <br />
