<br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY
<br />OF CASSELBERRY, FLORIDA, APPROVING AND
<br />AUTHORIZING THE PARTIAL CLOSING, VACATION, AND
<br />ABANDONMENT OF TWO SEPARATE 5' UTILITY
<br />EASEMENTS OWNED BY CENTURY LINK (FORMERLY
<br />UNITED TELEPHONE COMPANY OF FLORIDA) ON LOT 9,
<br />BLOCK B, AS RECORDED IN OFFICAL RECORD BOOK 1497,
<br />PAGE 951 AND ON LOT 2, BLOCK B, AS RECORDED IN
<br />OFFICAL RECORD BOOK 1459, PAGE 420 PUBLIC RECORDS
<br />OF SEMINOLE COUNTY, FLORIDA, PARCEL ID 17-21-30-536-
<br />0000-0010 LOCATED AT 2905 LAKEVIEW DRIVE,
<br />CASSELBERRY, FLORIDA; PROVIDING FOR CONFLICTS,
<br />SEVERABILITY, AND EFFECTIVE DATE.
<br />WHEREAS, on June 29, 2018 a petition was filed with the City Commission of the City of
<br />Casselberry, Florida to close, vacate, and abandon two separate easements owned by Century Link
<br />(formerly United Telephone Company of Florida), one on Lot 9, Block B, as recorded in Official Record
<br />Book 1497, Page 951, and the other on Lot 2, Block B, as recorded in Official Record Book 1459, Page
<br />420, Public Records of Seminole County, Florida, Parcel ID 17-21-30-536-0000-0010 located at 2905
<br />Lakeview Drive, Casselberry, FL; and
<br />WHEREAS, the City Commission finds that completely closing, vacating, and abandoning the
<br />sections of the aforesaid easements, including renouncing any public rights of ingress and egress, will not
<br />present a detriment to either the City of Casselberry, Florida, or the public.
<br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
<br />OF CASSELBERRY, FLORIDA, AS FOLLOWS:
<br />SECTION I. The City Commission of the City of Casselberry hereby approves the closing,
<br />vacation, and abandonment of two separate easements owned by Century Link (formerly United
<br />Telephone Company of Florida), one on Lot 9, Block B, as recorded in Official Record Book 1497, Page
<br />951 and the other on Lot 2, Block B, as recorded in Official Record Book 1459, Page 420 (as described
<br />in Exhibit `A' attached), Public Records of Seminole County, Florida, Parcel ID
<br />17-21-30-536-0000-0010 located at 2905 Lakeview Drive, Casselberry, FL.
<br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the
<br />provisions of this Resolution are hereby repealed.
<br />SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be
<br />invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or
<br />effect of any other Section or part of this Resolution.
<br />SECTION IV. Effective Date. This Resolution shall become effective immediately upon its
<br />passage and adoption.
