Planning & Zoning Commission/ <br />Local Planning Agency <br />July 12, 2017 <br />Page 2 <br />Fifth Item of Business: CU 17-12: 1830 State Road 436. A conditional use request to allow vehicular sales <br />and leasing at 1830 State Road 436. Parcel ID 34-21-30-300.014F-0000 <br />Mr. Dean Fathelbab, Planner I, reviewed the information provided in his memorandum dated July 12, 2017, <br />and a PowerPoint presentation to the City of Casselberry Planning and Zoning Commission (a copy of the <br />PowerPoint presentation is attached and made a part of the minutes). <br />Mr. Fathelbab said staff recommends the Planning and Zoning Commission approve CU 17-12 to allow <br />vehicular sales at the property located at 1830 State Road 436. He said staffs approval is based on the findings of <br />fact and conclusions of the staff report dated July 12, 2017 and the ten (10) conditions of approval outlined in the <br />staff report. <br />Mr. Henson asked the applicant to come forward. Mr. Amir Rauf, 1830 State Road 436, Winter Park, <br />Florida came forward. A brief discussion ensued regarding prohibiting parking of vehicles in the right of way and <br />servicing of vehicles. In response to the Commission's question, Mr. Rauf said he agrees with the conditions of <br />approval. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />Mr. Henson stated that this site has been used for a car lot for many years and questioned if this item could <br />be approved at an administrative level. Mr. Fathelbab said based on Table 2-5.3, Land Use by District, this use <br />requires review by the Planning and Zoning Commission. He said staff is actively reviewing Table 2-5.3 to make it <br />more business friendly, provide flexibility and make the City more marketable. <br />Mr. Henson asked for a motion to address CU 17-12. Mr. Lutz made a motion that the Planning and Zoning <br />Commission approve CU 17-12 to allow vehicular sales at the property located at 1830 State Road 436 and the <br />approval is based on the findings of fact and conclusions of the staff report dated July 12, 2017 and the ten (10) <br />conditions of approval outlined in the staff report including attachments A - C. Mr. Van Meter seconded the motion. <br />The motion passed unanimously by voice vote. <br />
