CE -17-001529 530 Hibiscus Rd <br />® Construction without a permit, City Code Section 1-4.3 <br />® Designated parking, ULDR Section 3-10.9(b)(1) <br />Mark Campbell, Code Compliance Supervisor advised that case number CE -17-001529 located at 530 Hibiscus <br />in zoning district R-8, was for the violation of construction without a permit, City Code Section 1-4.3 and <br />Designated parking, ULDR Section 3-10.9(b)(1). Notification date was October 28, 2017, correction date <br />requested was November 15, 2017 found non-compliant. Hearing Notice date was January 23, 2018, correction <br />date requested was February 7 found non-compliant. <br />The property was found to be non-compliant on February 8, 2018. The City requests a correction date of February <br />22, 2018. If no compliance by February 22, 2018 then a fine of $50.00 per day per violation, should then be <br />imposed for each day of non-compliance thereafter. <br />Tim Alcure, Senior Code Compliance Officer advised that he had made contact with the owner by phone. The <br />property was purchased in 1996; prior to purchasing the home, the area was already converted. Mr. Alcure <br />described photos. The property owner has made additional changes to the windows, as well as adding a door to <br />the side. The owner admitted that his changes were made without permits and permits have not been located for <br />the original conversion, prior to 1996. <br />The owner was introduces to the Chief Planner (Emily Hanna), Ms. Hanna will work with the owner. The City <br />will work with the owner as best they can. <br />David Zeroll, 530 Hibiscus Rd. Mr. Zeroll advised that he purchased the home in 1996; the original owners <br />disclosed that the enclosure was done without a permit, that was in the paperwork when the house was purchased. <br />The original owner, realtor and Mr. Zeroll all called the City for the issue of not having a permit. The City stated <br />since it was an existing condition and had been there a while; there was not an issue with that. <br />Mr. Zeroll stated that several years later, he approached the City again and explained the situation; he was told <br />there was nothing the City could do and advised him to just not bring it up. Other houses in the area are in the <br />same situation, so there should not be any problems. Mr. Zeroll continued. <br />Mr. Zeroll advised that recently it was deteriorating and the windows were not working right, so that portion was <br />covered up, made repairs and it looked worse than before. After the recent hurricane the tarp was taken off and <br />the shrubbery that was growing, that is what triggered everything. The windows and door were replaced without <br />a permit due to the resistance from the City in the past. <br />Mr. Zeroll stated that one of the problems is that there needs to be a carport or garage to leave the space enclosed <br />and there is not enough space on the property. <br />The Special Magistrate stated there are actually two violations, the other for designated parking. <br />Mr. Zeroll stated it was his understanding that the pickup truck was parked beside the house.
