RESOLUTION 18-3035 <br />A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, <br />AUTHORIZING THE EXECUTION OF AN AMENDMENT TO THE <br />VACANT LAND CONTRACT BETWEEN JOHN CASSELBERRY AND <br />THE CITY OF CASSELBERRY FOR THE PROPERTY LOCATED AT S. <br />LOST LAKE LANE, PARCEL ID 09-21-30-5BO-OA00-OO1C; PROVIDING <br />FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the City Commission of the City of Casselberry entered into a Contract for <br />Purchase and Sale dated October 30, 2017 (hereinafter "Contract"), and the Seller requests <br />another extension of the Closing Date to provide more time to negotiate a settlement of a <br />foreclosure lawsuit on another parcel of real property owned by Seller; and <br />WHEREAS, the Seller has already utilized his two unilateral closing date extensions <br />under the terms of the Contract. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF CASSELBERRY, <br />FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the First <br />Amendment to the Vacant Land Contract with John Casselberry (attached hereto as "Exhibit <br />A"), and authorizes the Mayor to execute said First Amendment on behalf of the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of <br />the provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />SECTION IV. Effective Date.
