RESOLUTION 18-3030 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE EXECUTION OF A COOPERATIVE AGREEMENT WITH THE NATURAL RESOURCES CONSERVATION SERVICE FOR GEE CREEK AND HOWELL CREEK EROSION CONTROL DUE TO HURRICANE IRMA; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the City of Casselberry experienced significant erosive damage within the Gee Creek and Howell Creek drainage basins as a result of Hurricane Irma in September 2017; and WHEREAS, the City Commission authorized City staff to submit an application to the United States Department of Agriculture Natural Resources Conservation Service (USDA NRCS) in an effort to obtain a grant to help fund improvements needed to address the aforementioned damage; and WHEREAS, the USDA NRCS has agreed to award the City funding to assist with the erosion control in Gee Creek and Howell Creek basins via a Cooperative Agreement; and WHEREAS, said Agreement provides for a total amount of financial assistance not to exceed $788,686.10 ($695,899.50 for construction and $92,786.60 for technical assistance), and a required 25% construction funding match (or $231,966.50) from the City; and WHEREAS, City staff has reviewed the Cooperative Agreement submitted by the United States Department of Agriculture Natural Resources Conservation Services and finds it favorable to meet the needs of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the Cooperative Agreement with the United States Department of Agriculture Natural Resources Conservation Service for Gee Creek and Howell Creek erosion due to Hurricane Irma, for a total amount not to exceed $788,686.10, and authorizes the Mayor to execute said document on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution.
