(E) While homeowners' associations associated with Excluded Subdivisions fund
street lights which illuminate platted roadways, a multi -family parcel funds lighting within that
parcel, much as a large commercial parcel funds interior lighting to illuminate parking and
building access. The function of the street lights funded by the respective homeowners'
associations for Excluded Subdivisions is the same as the function of the street lights
funded by the City's assessment program, that is, the lighting of platted right-of-ways.
Therefore, if Excluded Subdivisions were not exempted from the Street Lighting
Assessments, Tax Parcels in those subdivisions would be funding street lighting on platted
right-of-ways twice, once through the Assessment and again through the membership fees
and dues paid by association members.
(F) However, in multi -family parcels comprising apartment complexes, the lights
that are funded internally for illumination within the parcel are not duplicative of the lights on
platted external right-of-ways funded by the Street Lighting Assessments. Therefore, it is
appropriate to include multi -family parcels in the Street Lighting Assessment program and to
treat such parcels as General Parcels for purposes of apportionment.
(G) The Street Lighting Services contemplated herein are essential municipal
services which possess a logical relationship to the use and enjoyment of, and provide a
special benefit to, Developed Property and the costs associated with such services may be
recovered, in whole or in part, through the imposition and collection of Street Lighting
Assessments.
(H) The provision of Street Lighting Services specially benefits all Developed
Property by protecting and enhancing its value, use and enjoyment.
FA
