RESOLUTION 17-2996 A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING AN EXISTING PLANNED UNIT DEVELOPMENT AGREEMENT WITH THE ALLEGRO AT CASSELBERRY, LLC; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, all parties understand the use and associated ancillary uses found within an assisted living facility; and WHEREAS, the First Amendment to the Planned Unit Development Agreement with Allegro at Casselberry, LLC provides allowances for onsite consumption of alcohol for residents and guests of the senior project; and WHEREAS, the City Commission agrees that the First Amendment to the Planned Unit Development Agreement is in keeping with the type of ancillary uses found at an assisted living facility. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Casselberry, Florida: SECTION I. The City Commission hereby accepts the terms and conditions as presented in said First Amendment to the Planned Unit Development Agreement with Allegro at Casselberry, LLC. SECTION II. The City Commission approves the First Amendment to the Planned Unit Development Agreement with Allegro at Casselberry, LLC and authorizes the Mayor to execute said document, attached as "Exhibit "A" and made a part hereof. SECTION III. CONFLICTS. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION IV. SEVERABILITY. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution.
