RESOLUTION 17-2997 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE <br />CITY MANAGER TO EXECUTE A TITLE VI/NONDISCRIMINATION <br />ASSURANCE DOCUMENT TO PROVIDE THE FLORIDA DEPARTMENT <br />OF TRANSPORTATION ASSURANCE OF COMPLIANCE WITH <br />CERTAIN TITLE VI/NONDISCRIMINATION REQUIREMENTS; <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE <br />DATE. <br />WHEREAS, the City of Casselberry is committed to ensuring that no person shall on the <br />basis of race, color, national original, sex, age, disability, family or religious status be excluded <br />from participation in, be denied the benefits of, or be otherwise subjected to discrimination or <br />retaliation under any City program or activity; and <br />WHEREAS, the City of Casselberry wishes to attain Project -specific Local Agency <br />Program (LAP) Certification in order to manage the proposed "Sunset Drive Livable Street <br />Improvements" project and other projects in the Florida Department of Transportation (FDOT) <br />Work Program; and <br />WHEREAS, execution of the Title VI/Nondiscrimination Assurance document (attached <br />as Exhibit `A') provides for the City Manager's assurance that FDOT criteria will be followed <br />and is a requirement for LAP Certification; and <br />WHEREAS, City staff has reviewed the Title VI/Nondiscrimination Assurance <br />document and find it acceptable to meet the needs of the City. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves and <br />authorizes the City Manager to execute the Title VI/Nondiscrimination Assurance document, <br />attached as Exhibit `A'. <br />SECTION IL Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />SECTION IV. Effective Date. This Resolution shall become effective immediately upon <br />its passage and adoption. <br />
