and determines that there is competent substantial evidence to support the findings and <br />determinations made in this Section. <br />SECTION II. DEFINITIONS. For purposes of this ordinance, the following terms will <br />be defined as follows: <br />"Department" means the Florida Department of Health or its successor agency. <br />"Low -THC Cannabis" has the meaning as defined in Section 381.986(1), Florida <br />Statutes. <br />"Marijuana" has the meaning as defined in Section 381.986(1), Florida Statutes. <br />"Medical Marijuana Treatment Center" means any entity that acquires, cultivates, <br />possesses, processes (including development of related products such as food, tinctures, aerosols, <br />oils, or ointments), transfers, transports, sells, distributes, dispenses, or administers marijuana, <br />products containing marijuana, related supplies, or educational materials to qualifying patients or <br />their caregivers and is registered by the Department. <br />"Medical use" means the acquisition, possession, use, delivery, transfer, or administration <br />of an amount of marijuana not in conflict with Department rules, or of related supplies by a <br />qualifying patient or caregiver for use by the caregiver's designated qualifying patient for the <br />treatment of a debilitating medical condition. <br />SECTION III. MORATORIUM IMPOSED. Except where pre-empted or otherwise <br />inconsistent with Florida law, a moratorium is hereby imposed upon the operation of any Medical <br />Marijuana Treatment Center dispensing facility in the City of Casselbeny, and a zoning moratorium <br />is hereby declared and imposed as follows: <br />1. The City of Casselberry will not accept, process, or approve any application for <br />business tax receipts, building permits, land use/zoning permits, or any other <br />development permits concerning or related to any and all Medical Marijuana <br />Treatment Center dispensing facilities. <br />2. The cultivation and processing of Low -THC Cannabis shall not be subject to this <br />temporary moratorium. <br />SECTION IV. DURATION OF MORATORIUM. The temporary moratorium imposed <br />by this ordinance will be effective beginning on the effective date of this ordinance and continuing <br />until May 27, 2018, unless rescinded sooner. <br />0 <br />
