RESOLUTION 18-3006 A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, IN WHICH THE CITY AGREES TO ASSUME RESPONSIBILITY FOR DESIGNATION OF THE CITY AS A BIRD SANCTUARY, AS REQUIRED BY FLORIDA FISH AND WILDLIFE CONSERVATION COMMISSION RULES; PROVIDING FOR CONFLICTS, SEVERABILITY AND AN EFFECTIVE DATE. WHEREAS, in Ordinance 17-1468, the City Commission expressed their desire to designate the City limits as a bird sanctuary, and now the City would like to apply to the Florida Fish and Wildlife Conservation Commission (FWC) for official recognition; and WHEREAS, the City of Casselberry is highly urbanized and is largely residential in nature, and the City Commission is concerned that duck hunting in the City limits is unsafe, and in a desire to protect the City residents, seeks a bird sanctuary designation from FWC to apply throughout the City; and WHEREAS, Florida Administrative Code Rule 68A-19.002, entitled Establishment of Restricted Hunting Areas, and Bird Sanctuaries, Procedure, provides that the City must agree to post signs in the City and enforce FWC rules within the City in order to obtain this official recognition from FWC. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City of Casselberry officially agrees to assume the responsibility for enforcement of regulations of the Florida Fish and Wildlife Conservation Commission which apply to property within the City limits which is designated a bird sanctuary for the protection of all birds and other wildlife, and to designate the entire City as a restricted hunting area. The City agrees to post signs throughout the City bearing the words "RESTRICTED HUNTING AREA, Hunting by Special Permit Only" or `BIRD SANCTUARY, No Hunting" established by Rule 68A-19.002, F.A.C., which shall be placed at intervals of no more than 500 feet, be easily visible from any point of ingress or egress and further agrees to provide other necessary notice of such area to the public. The City agrees to instruct its duly authorized law enforcement personnel to enforce said regulations within the City. SECTION II. The City Clerk is hereby directed to provide a copy of this resolution to the FWC. SECTION III. CONFLICTS. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION IV. SEVERABILITY. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution.
