RESOLUTION 18-3006 <br />A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, IN <br />WHICH THE CITY AGREES TO ASSUME RESPONSIBILITY FOR <br />DESIGNATION OF THE CITY AS A BIRD SANCTUARY, AS REQUIRED <br />BY FLORIDA FISH AND WILDLIFE CONSERVATION COMMISSION <br />RULES; PROVIDING FOR CONFLICTS, SEVERABILITY AND AN <br />EFFECTIVE DATE. <br />WHEREAS, in Ordinance 17-1468, the City Commission expressed their desire to <br />designate the City limits as a bird sanctuary, and now the City would like to apply to the Florida <br />Fish and Wildlife Conservation Commission (FWC) for official recognition; and <br />WHEREAS, the City of Casselberry is highly urbanized and is largely residential in <br />nature, and the City Commission is concerned that duck hunting in the City limits is unsafe, and <br />in a desire to protect the City residents, seeks a bird sanctuary designation from FWC to apply <br />throughout the City; and <br />WHEREAS, Florida Administrative Code Rule 68A-19.002, entitled Establishment of <br />Restricted Hunting Areas, and Bird Sanctuaries, Procedure, provides that the City must <br />agree to post signs in the City and enforce FWC rules within the City in order to obtain this <br />official recognition from FWC. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City of Casselberry officially agrees to assume the responsibility for <br />enforcement of regulations of the Florida Fish and Wildlife Conservation Commission which <br />apply to property within the City limits which is designated a bird sanctuary for the protection of <br />all birds and other wildlife, and to designate the entire City as a restricted hunting area. The City <br />agrees to post signs throughout the City bearing the words "RESTRICTED HUNTING AREA, <br />Hunting by Special Permit Only" or `BIRD SANCTUARY, No Hunting" established by Rule <br />68A-19.002, F.A.C., which shall be placed at intervals of no more than 500 feet, be easily visible <br />from any point of ingress or egress and further agrees to provide other necessary notice of such <br />area to the public. The City agrees to instruct its duly authorized law enforcement personnel to <br />enforce said regulations within the City. <br />SECTION II. The City Clerk is hereby directed to provide a copy of this resolution to <br />the FWC. <br />SECTION III. CONFLICTS. All Resolutions or parts of Resolutions in conflict with <br />any of the provisions of this Resolution are hereby repealed. <br />SECTION IV. SEVERABILITY. If any Section or portion of a Section of this <br />Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or <br />impair the validity, force, or effect of any other Section or part of this Resolution. <br />
