WHEREAS, the moratorium imposed pursuant to Ordinance 15-1426 expired on <br />January 9, 2016; and <br />WHEREAS, on April 11, 2016, in accordance with then -existing state law, the City <br />adopted Ordinance 16-1439, enacting location, site, operational requirements, and other <br />standards regarding the location of Medical Marijuana Treatment Centers and Medical <br />Marijuana Dispensaries; and <br />WHEREAS, given the current uncertainty regarding the laws applicable to medical <br />cannabis, and Medical Marijuana Treatment Center dispensing facilities, the City Commission <br />has determined that it is necessary to further review its land development regulations and <br />standards in regard to the location and operation of the same; and <br />WHEREAS, the City Commission has determined that it is advisable and in the public <br />interest to contemporaneously, with the adoption of this moratorium, repeal its land development <br />regulations relating to Medical Marijuana Treatment Centers and Medical Marijuana <br />Dispensaries, as set forth in Ordinance 17-06 in an effort to conform with current state law; and <br />WHEREAS, the City Commission desires for its staff to have sufficient time to review <br />and make recommendations for the enactment of new land development regulations governing <br />said activities consistent with current state law; and <br />WHEREAS, the City Commission believes that by re-establishing a moratorium for 180 <br />days on the issuance of business tax receipts or land use approvals for Medical Marijuana <br />Treatment Center dispensing facilities, the City will have the opportunity to research and study <br />various regulatory options; and <br />WHEREAS, the City Commission finds the adoption of this Ordinance is in the public <br />interest by serving to promote and protect public health, safety, and welfare and otherwise serves <br />a municipal purpose for the City of Casselberry; and <br />WHEREAS, the City has authority in accordance with the Florida Constitution, Chapters <br />163, and 166 of the Florida Statutes, to enact regulations in the interest of the public health, <br />safety, and welfare of its citizens; and <br />WHEREAS, on July 12, 2017, the Planning and Zoning Commission reviewed and <br />recommended approval of Ordinance 17 -XXX (LPA 17-06). <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />3 <br />
