WHEREAS, this Ordinance is enacted pursuant to the Florida Municipal Home Rule
<br />Powers Act, Chapters 163 and 180, Florida Statutes, and other applicable laws authorizing a
<br />municipality to set rates, fees and charges for sewer, reclaimed water and water, including the
<br />Florida Impact Fee Act, Section 163.31801, Florida Statutes; and
<br />WHEREAS, The City Commission finds that it is in the best interest of the health,
<br />safety, and general welfare of the citizens of Casselberry and the sewer, reclaimed water and
<br />water customers of the City of Casselberry to amend the sewer, reclaimed water and water rates
<br />in accordance with the provisions hereof, and
<br />WHEREAS, words with double underlined type shall constitute additions to the original
<br />text and strike through type shall constitute deletions to the original text, and asterisks (* * *)
<br />indicate that text shall remain unchanged fiom the language existing prior to adoption of this
<br />Ordinance.
<br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE
<br />CITY OF CASSELBERRY, FLORIDA:
<br />SECTION I. RECITALS. The above recitals (whereas clauses) are hereby adopted as
<br />the legislative and administrative findings of the City Commission. The City Commission finds
<br />and determines that there is competent substantial evidence to support the findings and
<br />determinations made in this Section.
<br />SECTION 2. AMENDMENT OF SECTIONS 86-27, 86-30, 86-161, 86-221, and 86-
<br />279. That Sections 86-27 and 86-30 of Article II, Sewers, and Sections 86-161, 86-221 and 86-
<br />279 of Article IIl, Water, of Chapter 86, Utilities, of the City Code of Ordinances are hereby
<br />amended as shown in Attachment "A."
<br />SECTION 3. AMENDMENT OF CHAPTER 86, UTILITIES. That Section 86-3 of
<br />Article I, In General; Sections 86-68, 86-70, 86-72, and 86-82 of Article II, Sewers; and Sections
<br />86-161, 86-162, 86-166, 86-186, 86-187, 86-188, 86-189, 86-191, 86-222, 86-223, 86-226, and
<br />86-227 of Article III, Water, of Chapter 86, Utilities, of the City Code of Ordinances, are hereby
<br />repealed in their entirety and substituted with the Code provisions as shown in Attachment `B."
<br />SECTION 4. CODIFICATION. It is the intention of the City Commission of the City
<br />of Casselbeiry, Florida, and it is hereby ordained that the provisions of this Ordinance shall
<br />become and be made a part of the Code of Ordinance of the City of Casselberry, Florida; that the
<br />Sections of this Ordinance may be renumbered or re -lettered to accomplish such intention; that
<br />the word, "Ordinance" may be changed to "Section," "Article," or other appropriate word.
<br />SECTION 5. CONFLICTS. All Ordinances or Resolutions, or parts of Ordinances or
<br />Resolutions in conflict with any provisions of this Ordinance are hereby repealed to the extent of
<br />the conflict.
