ORDINANCE 17-1470 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />TO AMEND THE CITY OF CASSELBERRY COMPREHENSIVE <br />PLAN BY AMENDING THE FUTURE LAND USE MAP, <br />AMENDING THE FUTURE LAND USE DESIGNATION FROM <br />INDUSTRIAL TO COMMERCIAL FOR THE PARCEL LOCATED <br />IN THE VICINITY OF ANCHOR ROAD AND WEST MELODY <br />LANE AS DESCRIBED IN SECTION I OF THIS ORDINANCE; <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN <br />EFFECTIVE DATE. <br />WHEREAS, the property described in Section 1 is within the corporate boundaries of the <br />City of Casselberry; and <br />WHEREAS, such property should be consistent with land uses of neighboring parcels to <br />allow for the most appropriate future development of the site; and <br />WHEREAS, property provided in Section 1 of this ordinance is less than 10 acres, <br />requiring a small scale amendment to the Comprehensive Plan; and <br />WHEREAS, Section 163.3187, Florida Statutes, establishes a process for adoption of <br />small scale comprehensive plan amendments including amendments to the Future Land Use Map <br />(FLUM); and <br />WHEREAS, the Planning and Zoning Commission / Local Planning Agency has held a <br />public hearing with due public notice to consider this FLUM amendment; and <br />WHEREAS, a Public Hearing on the question of amending the City of Casselberry <br />Future Land Use Map designations of the property hereinafter described, has been duly held by <br />the City Commission of the City of Casselberry, Florida, and at such hearing, interested parties <br />and citizens for and/or against the proposed establishment of the City of Casselberry Future Land <br />Use Map designation were heard; and <br />WHEREAS, after said Public Hearing, the City Commission of the City of Casselberry, <br />Florida, has held a public hearing to consider the Comprehensive Plan Amendment and has <br />determined that the future land use designation of said property provided in Section I, herein, <br />shall be established as specified as Commercial, as that designation is defined in Future Land <br />Use Element Objective FLU 1, as amended and supplemented, of the Conzpr°ehensive Plan of the <br />Cit)) of Casselberry, Florida; and <br />WHEREAS, such amendments are permitted, subject to the provisions of Chapter 163 of <br />the Florida Statutes, <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. That Chapter 66, Section 66-29 of the Code of Ordinances of the City of <br />Casselber rjj Florida, as amended and supplemented, said Chapter adopting the Conrpr•ehensive <br />Plan of the Cit}) of Casselberry Florida, regulating and restricting the use of lands within the <br />City of Casselberry, Florida, be, and the same is, hereby amended to designate the subject <br />
