RESOLUTION 17-2994 <br />A RESOLUTION OF THE CITY COMMISSION OF CASSELBERRY, <br />FLORIDA, RECOGNIZING AND CONFIRMING LEGISLATION IN <br />PROGRESS REGARDING SECTION 3-16.8(B)(7) OF THE UNIFIED <br />LAND DEVELOPMENT REGULATIONS, TO INCREASE THE NUMBER <br />OF SMALL STATIC SIGNS PERMITTED ON A PREMISES FROM TWO <br />TO THREE; PROVIDING FOR LEGISLATIVE FINDINGS; <br />RECOGNIZING LEGISLATION IN PROGRESS; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. <br />WHEREAS, the City Commission has previously found that electronic signs can be <br />distracting and unsightly, but in order to ensure the public is informed of changing conditions, it <br />would be beneficial and appropriate to amend the Unified Land Development Regulations to <br />change the number of small electronic signs of no more than four characters from two to three <br />per premises; and <br />WHEREAS, the City Commission directs Staff to begin the process of amending the <br />Unified Land Development Regulations to accomplish this amendment. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF <br />THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. Legislative Findings. The above recitals are hereby adopted as the <br />legislative findings of the City Commission. <br />SECTION II. Recognizing Legislation in Progress. The City of Casselberry hereby <br />recognizes and confirms that legislation is in progress to adopt amendments to Section 3- <br />16.8(B)(7) of the Unified Land Development Regulations to state that <br />"a premises is allowed a maximum of three static LED signs no more than 4.5 square feet with <br />photocells that display a maximum of four characters", instead of limiting one premises to two <br />such small signs. Staff is directed not to issue any permits or approve applications for building <br />permits, development orders or other land use activity within the City of Casselberry which <br />would conflict with the pending amendments. <br />SECTION III. CONFLICTS. All Resolutions, or parts of Resolutions in conflict with <br />any provisions of this Resolution are hereby repealed to the extent of the conflict. <br />SECTION IV. SEVERABILITY. If any Section or portion of a Section of this <br />Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or <br />impair the validity, force, or effect of any other Section or part of this Resolution. <br />SECTION V. EFFECTIVE DATE. This Resolution shall become effective <br />immediately after passage and adoption. <br />
