RESOLUTION 17 -2988 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND ADOPTING THE CITY <br />OF CASSELBERRY STORMWATER AND LAKES MANAGEMENT <br />MASTER PLAN AND ASSOCIATED STORMWATER AND LAKE <br />MANAGEMENT UTILITY FEE SCHEDULE; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry is authorized pursuant to Section 403.0893, Florida <br />Statutes, and the Florida Home Rule Powers Act, to create a stormwater utility and adopt <br />stormwater utility fees sufficient to plan, construct, operate and maintain stormwater management <br />systems; and <br />WHEREAS, the City of Casselberry is dedicated to maintaining a stormwater system for <br />the benefit of real property within the municipal boundaries of the City of Casselberry in order to <br />provide proper drainage infrastructure to mitigate against flooding; provide recharge to the aquifer; <br />provide storage for stormwater runoff so that it does not adversely impact downstream receiving <br />water bodies; and provide other stormwater retention benefits; and <br />WHEREAS, the City of Casselberty stormwater utility is an enterprise fund which is <br />established to ensure stable funding for operation, maintenance, and capital projects that are <br />necessary for addressing flooding issues and meet the required level of service adopted by law; and <br />WHEREAS, the City of Casselber7y recognizes the importance of stormwater and lakes <br />management for natural resource protection, water quality, flood risk reduction, and quality of life; <br />and <br />WHEREAS, the City of Casselberry has adopted Article V, Stormwater and Lake <br />Management, providing for the establishment of a Stormwater and Lake Management Utility, and <br />Section 86 -304 provides for the establishment of stormwater and lake management utility rates by <br />resolution; and <br />WHEREAS, the City of Casselberry has engaged Vanasse Hangen Brustlin, Inc. to <br />conduct a detailed planning effort to technically evaluate, analyze, and establish the City's <br />methodology used in imposing stormwater charges based on the beneficiaries' relative contribution <br />to the need for the City's stormwater utility, that has resulted in a new City of Casselberry <br />Storniwater and Lakes Management Master Plan; and <br />WHEREAS, said Master Plan identifies and prioritizes a 10 -year capital improvement <br />program outlining necessary stormwater and lake management projects; and <br />WHEREAS, operational and regulatory requirements associated with the National <br />Pollutant Discharge Elimination System (NPDES), which requires the City to implement and fund <br />a comprehensive Stormwater management program, and Total Maximum Daily Loads (TMDLs) <br />were reviewed and incorporated into the Master Plan; and <br />
