<br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
<br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE
<br />CLOSING, VACATION, AND ABANDONMENT OF A 25' EASEMENT ON
<br />LOT 40, BLOCK B, OF SPORTSMAN'S PARADISE, RECORDED IN O.R.
<br />BOOK 872, PAGE 671, PUBLIC RECORDS OF SEMINOLE COUNTY,
<br />FLORIDA; AND PREVIOUSLY PARTIALLY VACATED BY ORDINANCE
<br />642; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE
<br />DATE.
<br />WHEREAS, in December 2015, a petition was filed with the City Commission of the
<br />City of Casselberry, Florida to close, vacate, and abandon an easement on Lot 40, Block B, of
<br />Sportsman's Paradise, more particularly described in Exhibit "A ", and recorded in O.R. Boole
<br />872, Page 671, Public Records of Seminole County, Florida; and
<br />WHEREAS, in 1989, per Ordinance No. 642 of the City of Casselberry, recorded in
<br />Book 2109, Page 1804 of Official Records of Seminole County, Florida, in response to a
<br />previous petition, the City partially vacated aforesaid easement, retaining only rights of ingress
<br />and egress; and
<br />WHEREAS, the City Commission finds that completely closing, vacating, and
<br />abandoning aforesaid easement, including renouncing any public rights of ingress and egress,
<br />will not present a detriment to either the City of Casselberry, Florida, or the public.
<br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
<br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS:
<br />SECTION I. The City Commission of the City of Casselberry hereby approves the
<br />closing, vacation, and abandonment of a 25' easement on Lot 40, Block B, of Sportsman's
<br />Paradise (as described in Exhibit `A' attached) recorded in O.R. Boole 872, Page 671, Public
<br />Records of Seminole County, Florida, including renouncing any public rights of ingress and
<br />egress, and authorizes the Mayor to sign this resolution on behalf of the City Commission.
<br />SECTION H. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the
<br />provisions of this Resolution are hereby repealed.
