CASSLLBERRY CITY COMMISSION <br />Minutes of June 26, 2017 — Regular Meeting <br />Page 9 of 13 <br />ARTICLE XXI, "LANGUAGE AND DEFINITIONS" OF CHAPTER V, "GLOSSARY" TO ADD <br />DEFINITIONS; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY AND AN <br />EFFECTIVE DATE." <br />Staff Presentation: Chief Planner Emily Hanna gave a brief overview of Ordinance 17-1463 explaining that <br />the purpose of the ordinance was to amend the Unified Land Development Regulations (ULDR) to allow for <br />wireless communications within the City's rights of way. She advised that the reason for these changes to the <br />regulations was in response to legislation just signed by the Governor which allows these types of <br />communications to be placed in public rights of way. She stated that the City did not currently have anything <br />in its Code regulating that so staff felt it was important to have something within the Code regulating <br />performance standards such as height, location, appearance, and things of that nature. She shared some <br />photographs of various types of communication towers and antennas and facilities. She added that the <br />language in the Code had been edited to make it easier to understand, and definitions had been amended to <br />include wireless communication terms. <br />In response to questions from the Commission Ms. Hanna advised that staff had used the City of Orlando's <br />regulations as inspiration for some of the changes being made. She further advised that staff had worked <br />closely with the City Attorney to get some sort of regulation in place in the event of an application for <br />permitting; however, it would most likely be necessary to make some additional changes and to tweak the <br />ordinance at a future time. She also advised that utility companies were aware of the new legislation and that <br />cities were changing their codes in response. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval of <br />Ordinance 17-1463 on first reading. <br />Audience Participation: No one came forward to address Ordinance 17-1463. <br />MOTION: Vice Mayor Aram endia moved to approve Ordinance 17-1463 on first reading, <br />as presented. Motion was seconded by Commissioner Solomon. Motion carried <br />unanimously by voice vote 5-0. <br />B. Ordinance 17-1464 — Amending the City Code of Ordinances, Chapter 668, <br />Roadway and Utility Construction <br />The City Clerk read Ordinance 17-1464 by title as follows: <br />"AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, <br />RELATING TO COMMUNICATION FACILITIES; AMENDING CHAPTER 68, "ROADWAY AND <br />UTILITY CONSTRUCTION" OF THE CITY CODE OF ORDINANCES, BY AMENDING ARTICLE <br />II, "CONSTRUCTION AFFECTING STREETS, RIGHTS-OF-WAY OR EASEMENTS" TO <br />CLARIFY AND UPDATE RIGHTS-OF-WAY UTILIZATION AND PERMIT REQUIREMENTS, <br />AND BY AMENDING ARTICLE IV, "COMMUNICATIONS RIGHTS-OF-WAY", ESTABLISHING <br />NEW REGULATIONS FOR WIRELESS COMMUNICATION FACILITIES AND AMENDING <br />
