and General Regulations, Article XV — Offstreet Parking and Loading Requirements, Section 3- <br />15.2, Parking spaces required by use, of the Code of Ordinances of the City of Casselberry, <br />Florida, is amended as shown in Exhibit `B" attached and incorporated herein. <br />SECTION 4. Part III — Unified Land Development Regulations, Chapter II — District <br />and General Regulations, Article XVIII, Site Plan Review, Section 4-18.2, Applicability and <br />filing procedure, of Chapter IV, of the Code of Ordinances of the City of Casselberry, Florida, is <br />amended as follows: <br />x x x <br />6. Developments of community impacts reviewed by City Commission. The site plan of a <br />"development of community impact" shall be reviewed and acted upon by the City <br />Commission after considering recommendations of City staff and the Planning and <br />Zoning Commission. Developments which meet any one of the conditions stated below <br />shall be deemed to be a "Development of Community Impact." <br />a. Residential developments of community impact. Developments which include a <br />total of 75 or more dwelling units or at least five acres. In applying the above <br />criteria herein, the total number of units shall include the units in all phases of the <br />total project or development. Any units being replaced by the project shall be <br />subtracted in determining the applicability of this Subsection. <br />b. Nonresidential developments of community impacts. A nonresidential development <br />which includes a minimum of five acres or 50,000 square feet of net additional <br />gross floorspace. <br />c. MTMU Future Land Use District Development Any development zoned PMX- <br />MID (Planned Mixed Use: Medium Rise) or PMX- HIGH (Planned Mixed Use: <br />High Rise) that is three (3) acres or greater in size. <br />SECTION 5 - CODIFICATION. The City Commission of the City of Casselberry, <br />Florida, intends, and ordains that this Ordinance become a part of the Code of Ordinance of the <br />City of Casselberry, Florida; that the Sections of this Ordinance may be renumbered or re - <br />lettered to accomplish such intention; that the word, "Ordinance" may be changed to "Section," <br />"Article," or other appropriate word. <br />SECTION 6 - CONFLICTS. All Ordinances or parts of Ordinances in conflict with any <br />of the provisions of this Ordinance are repealed. <br />SECTION 7 - SEVERABILITY. If any Section or portion of a Section of this <br />Ordinance proves to be invalid, unlawful, or unconstitutional, it will not invalidate or impair the <br />validity, force, or effect of any other Section. <br />Ordinance 16-1446 <br />Page 4 of 7 <br />
