CASSELBERRY CITY COMMISSION <br />Minutes of May 8, 2017 — Regular Meeting <br />Page 5 of 15 <br />Staff Presentation: Chief Planner Emily Hanna gave a brief overview of Ordinance 17-1456, explaining <br />that the ordinance provided for amending the city's official zoning map for properties located at 1316, 1324 <br />and 1332 Lake Drive from OR (Office Residential to CG (Commercial General). She advised that the subject <br />properties were currently vacant; however, the applicant had received site plan approval, an engineering <br />permit, and a conditional use approval for a 40 -bed memory care facility on the site. She further advised that <br />the request for rezoning was compatible with the existing commercial future land use designation. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval of <br />Ordinance 17-1456 on first reading. <br />Audience Participation: No one came forward to address Ordinance 17-1456. <br />MOTION: Vice Mayor Aramendia moved to approve Ordinance 17-1456 on first reading, <br />as presented. Motion was seconded by Commissioner Hufford. Motion carried <br />unanimously by voice vote 5-0. <br />B. Ordinance 17-1458 — Amending Article V, Land Use by District and Article XVI, <br />Signs of the Unified Land Development Regulations and Chapter 14, Amusements <br />of the City Code of Ordinances <br />The City Clerk read Ordinance 17-1458 by title as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, RELATING TO SIGNS; <br />AMENDING PORTIONS OF PART IH UNIFIED LAND DEVELOPMENT REGULATIONS, <br />AMENDING ARTICLE V, SEC. 2-5.3(B) TO PROHIBIT OUTDOOR ADVERTISING; AMENDING <br />ARTICLE XVI, SIGNS, OF CHAPTER III, PERFORMANCE CRITERIA, OF THE CASSELBERRY <br />UNIFIED LAND DEVELOPMENT REGULATIONS TO ENSURE COMPLIANCE WITH <br />CONSTITUTIONAL AND OTHER LEGAL REQUIREMENTS AND TO PROVIDE A PURPOSE, <br />INTENT AND SCOPE; DELETING AND RESTATING VARIOUS DEFINITIONS; AMENDING <br />CRITERIA RELATED TO THE AMENDED DEFINITIONS; AMENDING CHAPTER 14, <br />AMUSEMENTS, SEC. 14-42, PERFORMANCE CRITERIA OF DIVISION 2, SPECIAL EVENTS, <br />ARTICLE H OF THE CODE OF ORDINANCES OF THE CITY OF CASSELBERRY, TO UPDATE <br />IN ACCORDANCE WITH RECENT DECISIONS; PROVIDING FOR CODIFICATION, <br />CONFLICTS, SEVERABILITY AND AN EFFECTIVE DATE." <br />Staff Presentation: Chief Planner Emily Hanna gave an overview of Ordinance 17-1458, explaining City <br />staff had reviewed the City's code relating to regulation of signs in response to a 2015 Supreme Court decision <br />in which the Town of Gilbert, Arizona was found to have violated the First Amendment by regulating signage <br />based on content. She stated that some of the proposed changes were as a result of this ruling, and some were <br />for the purposing of clarifying language and streamlining some processes. She then gave a PowerPoint <br />presentation highlighting details of the proposed amendments, which included changes to the following code <br />sections: <br />
